Inland Flood Protection Rule
NJDEP announced the filing of the Inland Flood Protection Rules to take effect in July 2023. The purpose is to better protect areas at risk from devastating impacts during extreme rainfall events in New Jersey.
The primary changes to the Flood Hazard Area Control Act Rules and Stormwater Management Rules include:
Raising the Design Flood Elevation (DFE) by two (2) feet in fluvial (non-tidal) flood areas
Habitable first-floor elevations will be two (2) feet higher than currently indicated on NJDEP State Flood Maps and three (3) feet higher than currently indicated on FEMA maps
Requiring current and future projected storm precipitation rates to be incorporated into the design requirements for stormwater Best Management Practices (BMP) and calculation of design flood elevations
Removes use of Rational and Modified Rational methods for stormwater calculations
